General Terms and Conditions (GTC)

1. Services and terms of the agreement

1.1 Fee-based services offered by König Tours GmbH & Co. KG include services for obtaining visas from foreign missions / foreign authorities and/or for obtaining a visa support letter or invitation, as well as advice on visa matters.

The services of König Tours GmbH & Co. KG are completed when the customer's documents have been checked for completeness and the visa or visa support letter has been received and handed over to the selected transportation company or delivered electronically. In any case, the decision to issue a visa is made exclusively by the Embassies and Ministries of the respective countries. The services of König Tours GmbH & Co. KG are also available if the responsible consulate has rejected the visa application, the responsible authority has refused to issue an invitation or if the entry requirements have been changed during the application process. It follows that the obligation to pay for the services provided by König Tours GmbH & Co. KG must be fulfilled even if the visa application has not been granted. König Tours GmbH & Co. KG reserves the right to reject orders without giving reasons and to outsource the fulfillment of the order to third parties.

1.2 König Tours GmbH & Co. KG will normally only start processing customer requests after confirmation of these Terms and Conditions (GTC). This is especially true if there is no online order at www.buch-dein-visum.de If the customer's documents cannot be linked to the online order upon receipt, the customer should confirm the Terms and Conditions by e-mail.

2. Visa and invitation processing terms

2.1 The processing time of a visa or visa support letter depends on the opening hours of the foreign mission to be contacted or the relevant ministry, König Tours GmbH & Co. KG and partner companies on behalf of König Tours GmbH & Co. KG and starts no earlier than 1 day after receipt of the complete set of documents. Public holidays in Germany and in the respective country of destination must be taken into account by the client. Due to public holidays or unscheduled closures of foreign authorities, the processing time may be extended and König Tours GmbH & Co. KG cannot influence this.

The processing times for visas and invitations offered by Königtours GmbH & Co. KG are determined in accordance with the regular opening hours and the established processing times of the relevant authorities.

König Tours GmbH & Co. cannot influence the processing times of the data in the respective case once it has been forwarded to the foreign representations / foreign authorities. The representative offices and authorities reserve the right to withhold documents from applicants in individual cases or selectively for a longer period of time for additional verification.

König Tours has the right to change the order processing time and delivery method in order to guarantee travel dates and to invoice the customer for additional costs. The same applies to price adjustments arising after receipt of the order due to changes in the official schedule of consular or registration fees.

2.2 Dispatch routes are not considered as processing times. All conditions listed in paragraph 2. must be taken into account by the customer when selecting the processing time. In most cases the invitation/reference number is sent by e-mail. This also applies to e-visa confirmations. It is the customer's responsibility to check his/her mailbox and spam folder to see if the invitation or e-visa confirmation has been received. If an invitation is ordered and must be presented to the consulate in the original, the client will receive it by mail.

2.3 Express visa

The issuance of an express visa for the date selected by the customer via König Tours GmbH & Co. KG can be realized at the price specified in the order only if the documents are received by the visa service before 8:00 am. If the customer's documents are received after 8:00 a.m. but no later than 9:00 a.m., König Tours GmbH & Co. KG has the right, at its discretion, to organize a special trip to the responsible representative office/authority in order to meet the delivery date requested by the client. Additional costs incurred in this regard will be charged to the customer.

3. Inappropriate delivery

3.1 If during the ordering process the customer has selected a shipping method for the return shipment that does not allow the visa or documents to be delivered on time, König Tours GmbH & Co. KG is entitled to select and invoice another delivery method at its discretion.

4. Offsetting prohibition

4.1 The offsetting of claims of König Tours GmbH & Co. KG is only valid for counterclaims that have been recognized as legally binding.

5.3 The cost of delivery depends on the delivery method selected during the checkout process. The price of the visa order does not include the shipping costs. If the customer chooses a delivery method that is not suitable for the visa type ordered, König Tours GmbH & Co. KG reserves the right to change the method of delivery and to charge the costs incurred.

5.4 If payment is not received in full, König Tours GmbH & Co. KG reserves the right to return the documents by cash on delivery and to charge the customer an additional fee.

5.5 Königtours GmbH & Co. KG has no influence on possible increases in consular fees after visa applications have been sent.

6. Responsibility

6.1 The decision to issue visas or invitations lies within the exclusive competence of the responsible foreign mission (Embassy) or the relevant authority. König Tours GmbH & Co. KG assumes no responsibility for this decision. König Tours GmbH & Co KG undertakes to provide the client with a service in the form of organizing the submission of the visa or invitation application to the competent authorities and the handing over of all issued visas or invitations and related documents to a transport company appointed or duly selected by the client. König Tours GmbH & Co. KG also undertakes to hand over the client's documents to the transport companies in such a way as to ensure that they are transported to the client without damage.

König Tours GmbH & Co. KG accepts no liability for damage, late delivery or loss of goods. KG accepts no liability whatsoever. König Tours GmbH & Co. KG passes on to the customer any claims that may arise against the transportation company due to loss, late delivery or damage to documents in transit. In case of delivery by e-mail, the customer is responsible for regularly checking his mailbox and spam folder.

The services of König Tours GmbH & Co. KG are also provided if the visa or invitation application has not been granted by the competent authority or if the processing times specified in the order process (see 2. Processing times for visas and invitations) are delayed due to temporary closure of the authorities or processing procedures by the authorities that were not foreseen by König Tours GmbH & Co.

6.2 The issuance of a visa by the authorities/ Embassy/Consulate does not guarantee entry into the country concerned. The decision on entry rests with the immigration officers/airport officials at the port of entry.

6.3 For damages caused to other legal entities by gross negligence or intent by the Customer in the course of order processing by Königtours GmbH & Co. KG, Königtours GmbH & Co. KG shall be liable for a maximum of EUR 800.00 in the case of visa orders or EUR 200.00 in the case of visa support letters. The amounts represent typical limits of possible damages in these service areas.

7. Cancellation

7.1 The withdrawal from the contract must be in writing (e-mail, letter, fax). This applies to both contractual partners.

7.2 Once the customer has placed a paid order using the “Order Visa” button and received an order number, free of charge cancellation of the order is no longer possible. In case of canceling the order, a lump sum of 25.00 euros will be charged.

The same applies if König Tours GmbH has already received the documents, processing has started and the documents have not yet been handed over to the responsible foreign office. Also in this case, the customer must pay a flat rate of € 25.00 plus shipping costs for return shipment in case of cancellation. In cases where the documents are already on their way to the responsible foreign office, the customer must pay a 100% cancellation fee.

7.3 Invitations. Invitations/letters to visa support cannot be canceled in accordance with § 312 d (4) No. 1 BGB, as they are customized.

8. Additional arrangements

8.1 Deviations (changes or amendments) from the Terms and Conditions (GTC) listed here, which arise on the basis of contracts or supplementary agreements, must be clearly documented in writing. This also applies to the waiver of the written form clause.

9. Jurisdiction

9.1 All disputes arising in connection with this agreement shall be governed by German law and both parties submit to the exclusive jurisdiction of the courts of the City of Brühl.

10. Final provisions

10.1 If individual provisions or determinable parts prove to be invalid, this will not affect the validity of the remaining terms of the contract.
